Summary

■ The CPS is a relatively new agency of the criminal justice system, established in 1985 to separate the process of investigation (undertaken by the police) from the decision to prosecute.

■ Thirteen CPS areas are responsible for the majority of prosecutions across 43 police force areas. A 24/7 CPS Direct service provides out-of-hours support for charging decisions.

■ CPS prosecutions must satisfy an ‘evidential test’ and a ‘public interest’ test, to ensure that there is both a realistic prospect of conviction and that it is in the public interest to do so.

■ Statutory charging systems have been in place since 2003 to reduce mistakes in charging decisions and to ensure that trials are not discontinued.

■ The role of the CPS has expanded to include victim liaison and advocacy, raising questions about its role as independent prosecutor for the state, while keeping victims and witnesses engaged and satisfied with their treatment.
